1. Who We Are

The Owner Manager Discipline Limited is the controller of personal information processed in connection with TOMD. For privacy-related queries, contact: support@tomd.ie

2. Information We Collect

Depending on how you use TOMD, we may collect and process:

  • your name, email address and account information;

Payments may be processed by third-party payment providers such as Stripe or PayPal. Where payment information is entered directly with a payment provider, TOMD does not receive or store your full card details.

3. How and Why We Use Your Information

We process personal information where necessary to:

  • create and administer your account and membership;
  • process and administer subscriptions and payments;
  • provide access to the Members Vault, live sessions, recordings and other TOMD services;
  • communicate with you about your membership, payments, sessions and the operation of TOMD;

  • protect the security and proper operation of TOMD and its services;
  • maintain appropriate business, accounting and legal records; and
  • comply with applicable legal obligations.

Our legal bases for processing include performance of our contract with you, compliance with legal obligations, our legitimate interests in operating, protecting and improving TOMD, and consent where consent is required.

Where we rely on legitimate interests, those interests include operating and protecting our business and services, administering memberships, communicating with members and maintaining appropriate business records.

4. Live Sessions and Recordings

TOMD live sessions may be recorded. Depending on your participation, a recording may contain your name, voice, image, comments or contributions. Recordings may be made available to TOMD members through the Members Vault or otherwise used in providing the TOMD membership service. You are responsible for the information you choose to disclose during a live session and should not disclose personal, confidential or commercially sensitive information that you are not entitled to disclose.

5. Who We Share Information With

We may share personal information where reasonably necessary with service providers used to operate TOMD, including providers of:

  • website hosting and technical services;
  • payment and subscription processing;
  • email and communications services;
  • video conferencing and video hosting;
  • booking and scheduling services; and
  • professional, accounting or legal services.

We may also disclose information where required by law or where reasonably necessary to establish, exercise or defend legal rights. We do not sell your personal information.

6. International Transfers

Some service providers used by TOMD may process personal information outside the European Economic Area. Where applicable, such transfers will be made subject to an applicable legal transfer mechanism or safeguard required by data protection law.

7. Cookies

Our website may use cookies and similar technologies necessary for its operation and, where applicable, other cookies or technologies for analytics or similar purposes. Where consent is legally required for a cookie or similar technology, it will not be used unless the required consent has been obtained. Cookie preferences can be managed through the cookie controls provided on the website, where applicable.

8. How Long We Keep Information

We retain personal information for as long as reasonably necessary for the purposes for which it was collected, including providing the TOMD service, maintaining appropriate business and transaction records, resolving disputes and meeting legal, accounting or regulatory requirements. Different categories of information may therefore be retained for different periods.

9. Security

We take appropriate technical and organisational measures to protect personal information against unauthorised access, loss, misuse, alteration or disclosure. No internet-based service or method of electronic storage can be guaranteed to be completely secure.

10. Your Rights

Subject to applicable data protection law, you may have rights to access, correct, erase or restrict the processing of your personal information, to receive certain information in a portable format, and to object to certain processing. Where processing is based on consent, you may withdraw that consent at any time without affecting processing carried out before withdrawal. To exercise your rights, contact support@tomd.ie. We may request information reasonably necessary to verify your identity and deal with your request. You also have the right to lodge a complaint with the Irish Data Protection Commission.
